Powo Studios LLC d/b/a Athena Text ("Company," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website at athenatext.com, when you sign up for and use our application at app.athenatext.com, and when you otherwise interact with our services (collectively, the "Service").
1. What Information Do We Collect?
Information You Provide
We collect information you voluntarily provide when using our Service, including:
- Name, phone number, and email address
- Zip code, age, and service preferences
- Company name, job title, country, and company size (when you submit a contact, sales, or demo request)
- Marketing-communications opt-in preference (when offered as an explicit checkbox on a form)
- Any other information you choose to provide via forms or communications
Specifically, when you complete the contact form on this site, we record the form fields you submit (work email, name, company, job title, country, company size, optional phone number, marketing-opt-in selection) along with the submission timestamp and the IP address and User-Agent string of the request, so we can respond to your inquiry, prevent abuse, and meet our compliance obligations.
Application Account Information
When you create an account on app.athenatext.com, we collect: your name, work email address, mobile phone number (used for one-time-passcode verification at signup), organization name, and the billing details required to process your subscription. Billing information (including payment card data) is collected and stored by our payment processor (Stripe) and not retained on Athena Text servers. We also collect data you provide when configuring your account, including business identity information used for toll-free verification (see Section 6a) and any Twilio sub-account credentials you supply, which are encrypted at rest.
Application Usage Information
As you use the application, we record an audit trail of significant events (sign-in, credential changes, lead exports, billing changes, and other administrative actions) including the timestamp, the acting user, and the IP address of the request. These records support security, compliance, and dispute resolution.
Information Collected Automatically
When you access the Service, we may automatically collect:
- IP address and approximate location
- Browser type, device type, and operating system
- Pages visited, time spent, and referral source
- Cookies and similar tracking technologies
Information from Third Parties
We may receive information about you from marketing partners, public databases, and lead generation platforms to supplement the data you provide.
2. How Do We Use Your Information?
We use the information we collect to:
- Provide, operate, and improve our Service
- Connect you with sales representatives or partners
- Send transactional communications (confirmations, updates, support)
- Send marketing communications (with your consent and opt-out capability)
- Analyze usage patterns and optimize user experience
- Comply with legal obligations and enforce our terms
- Prevent fraud and protect the security of our Service
3. Will Your Information Be Shared?
We may share your information in the following circumstances:
- With your consent - when you explicitly authorize sharing
- Service providers (subprocessors) - third parties that process data on our behalf to deliver the Service. These include: Twilio, Inc. (SMS delivery and toll-free verification), Anthropic, PBC (AI-powered conversation processing for inbound message qualification and AI-generated conversation summaries), Stripe, Inc. (payment processing and subscription billing), Supabase, Inc. (database hosting), Railway Corp. (application server hosting), Vercel, Inc. (dashboard and marketing site hosting and content delivery), Resend, Inc. (transactional email delivery for the marketing site), Discord, Inc. (optional notification delivery to tenant-configured Discord channels for qualified-lead alerts), and Cloudflare, Inc. (web analytics and content delivery for the marketing site). - Business partners - to connect you with representatives who can assist with your needs
- Legal requirements - when required by law, subpoena, or to protect our rights
- Business transfers - in connection with a merger, acquisition, or sale of assets
4. Text Messaging Consent and Data Use
When you opt into our SMS program, you consent to receive automated text messages related to our SMS marketing services. These messages are transactional and service-related, not promotional.
SMS consent and mobile phone numbers are not sold, rented, shared, or transferred to third parties for marketing purposes. Phone numbers may be shared with business partners solely for the purpose of voice call follow-ups you have requested.
You may opt out at any time by replying STOP. Reply HELP for assistance. Message frequency varies. Message and data rates may apply. We honor all state-specific text messaging regulations and TCPA requirements.
5. Cookies and Tracking Technologies
Our marketing site uses Cloudflare Web Analytics to measure aggregate usage (pages visited, referral sources, approximate location based on IP). Cloudflare's beacon is cookieless and does not use cross-site tracking, but it does collect your IP address and browser User-Agent string. Cloudflare's privacy practices are governed by the Cloudflare Privacy Policy.
The application at app.athenatext.com uses first-party session cookies for authentication and does not load third-party analytics or advertising trackers.
A cookie-consent management interface is planned for European Union and United Kingdom visitors and will be deployed in the weeks following launch. In the meantime, European Union and United Kingdom residents who wish to object to any data collection described above may contact us using the information in Section 13.
6. How Long Do We Keep Your Information?
We retain your personal information for the duration of your relationship with us and for a reasonable period thereafter to meet legal, compliance, and audit obligations. Specific retention periods include:
- Contact-form submissions: up to 12 months from the date of submission for sales follow-up and fraud-prevention purposes, after which they are archived or deleted.
- Account and conversation data: retained for the life of your Athena Text account. After account closure, conversation history and operational logs are retained for a reasonable period (typically up to 7 years) to support potential dispute resolution, regulator inquiries, and tax-record obligations, then securely deleted or anonymized.
- Consent records and opt-out records: retained for a minimum of 5 years (with opt-out records retained for 10 years under Virginia SB 1339) for telemarketing-compliance purposes.
- KYC / business-verification submissions: retained for the life of your account plus 3 years after closure to meet carrier-compliance recordkeeping obligations. Taxpayer identification numbers (EIN) are transmitted directly to our carrier partner (Twilio) and are not retained on Athena Text servers.
- Audit-log entries: retained for the life of your account for security and dispute-resolution purposes.
You may request deletion of your data at any time as described in Section 9.
6a. KYC / Business Verification Data
To send SMS messages from a toll-free number, United States carriers require us to verify your business identity through a process called toll-free verification. When you complete toll-free verification in your Athena Text account at app.athenatext.com, we collect: business legal name, website, business type, industry, street address, contact person name and email and phone and job title, use case category and description, expected message volume, opt-in method, opt-in page URL, opt-in screenshot URL, and sample messages. We transmit this information to Twilio, Inc. as our carrier partner so that they may submit it to the underlying mobile carriers for approval. Your EIN or taxpayer identification number, if provided, is sent only to Twilio and is not persisted on Athena Text servers. Twilio's privacy practices are governed by the Twilio Privacy Notice.
7. How Do We Keep Your Information Safe?
We implement appropriate technical and organizational security measures to protect your personal information, including encryption, access controls, and secure data storage. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
8. Information from Minors
Our Service is not directed to individuals under 18 years of age. We do not knowingly collect personal information from minors. If we discover that we have collected data from a person under 18, we will promptly delete that information. Parents or guardians who believe their child has provided us with personal information may contact us to request deletion.
9. Your Privacy Rights
You have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your personal information
- Opt out of marketing communications
- Request a copy of your data in a portable format

We will acknowledge your request within 30 days and complete the action within a reasonable time thereafter, subject to verification of your identity and the limited exceptions permitted by applicable law (for example, where we are required to retain records to meet a separate legal obligation, such as the consent and opt-out retention described in Section 6).
SMS Opt-Out and Data Deletion Are Different
Replying STOP to an SMS message places your phone number on our suppression list so that we will not send you further messages. STOP does not delete your underlying contact record, which we retain to enforce the opt-out across our customers and to meet the recordkeeping obligations described in Section 6. To request deletion of your contact record itself (not just opt-out from messaging), use the request mechanism above.
10. Do-Not-Track Signals
Some browsers offer a "Do Not Track" feature. We currently do not respond to DNT signals, as no uniform industry standard for DNT compliance has been established. If a standard is adopted in the future, we will update this policy accordingly.
11. California Residents
If you are a California resident, you have additional rights under the California Consumer Privacy Act and the California Privacy Rights Act (collectively, the "CCPA"), including the right to know what personal information we collect, the right to request correction or deletion, the right to opt out of the sale or sharing of personal information, the right to limit use of sensitive personal information, and the right to non-discrimination for exercising these rights.
We do not sell or share your personal information for cross-context behavioral advertising. To exercise any of your California privacy rights, including a "Do Not Sell or Share My Personal Information" request, contact us at [email protected] or use the contact information in Section 13. We respond to a verifiable consumer request within the time periods required by law (currently 45 days, extendable by an additional 45 days where reasonably necessary, with notice).
You also have rights to your data under the privacy laws of other states (including, depending on residency, Virginia, Colorado, Connecticut, Utah, and others). The mechanism described above is available regardless of your state of residence.
12. Updates to This Policy
We may update this Privacy Policy from time to time. The updated version will be indicated by the "Last Updated" date at the top of this page. We encourage you to review this policy periodically. Material changes will be communicated via a notice on our website or by direct communication.
